MAINLAND CHINA DISPUTES · FUJIAN EXPERIENCE

Commercial Claims Defence

Being pursued for payment does not mean every claimed amount or alleged obligation is accepted. We help overseas business owners and companies understand the claim, organise a response and consider practical settlement options in mainland China.

Start with an outline. Document review and formal advice follow an agreed scope and fee.

When we can help

  • A company receives a demand, claim or court document.
  • A shareholder or individual is asked to assume company liabilities.
  • The amount, performance of a contract or responsibility is disputed.
  • Several creditors or proceedings need a coordinated response.

What the mandate may cover

  • An initial review of the claim and relevant procedural dates.
  • An evidence and response plan identifying disputed issues.
  • Representation or settlement negotiations within the agreed scope.
  • Clear instructions on information and decisions needed from the client.

What to prepare

  • All received demands and court documents, with dates of receipt.
  • Contracts, payment records and relevant correspondence.
  • The identity of each claimant, defendant and related company.
  • Existing representation and any approaching deadline.

Before you begin

Should I wait until all documents are available?

If a deadline is approaching, flag it immediately and provide the documents already received. An online enquiry alone does not establish a retainer or suspend a deadline.

Can you advise both sides?

A conflict check comes before accepting a matter. Availability depends on the parties, related entities and existing engagements.

FEES & YOUR NEXT DECISION

Agree the scope before committing.

01

Confirm whether we can assist

Outline the issue, location, urgent dates and parties so scope and conflicts can be checked. Initial contact is not a formal legal opinion.

02

Agree a scoped assessment

Where a document review is needed, agree the fee and deliverables first: evidence gaps, possible routes and recommendations for the next stage.

03

Choose the next mandate

Negotiation, proceedings, enforcement or defence work is agreed by stage. Additional work and third-party expenses are identified separately.

The responsible firm, billing currency, payment account and payment method are confirmed in the engagement.
