MAINLAND CHINA DISPUTES · FUJIAN EXPERIENCE

Debt Recovery & Enforcement

When a debtor or its assets are in mainland China, the useful first question is what can realistically be recovered, through which route and at what cost. We help overseas clients and referring advisers assess the position and take the next appropriate step.

Start with an outline. Document review and formal advice follow an agreed scope and fee.

When we can help

  • Unpaid commercial invoices, contract payments or loans.
  • A mainland China judgment that has not been satisfied.
  • A disputed debt requiring negotiation, litigation or asset preservation.
  • Recovery involving property, shareholders or a distressed business.

What the mandate may cover

  • A review of the claim, available evidence and known asset information.
  • A proposed recovery route, staged scope and cost considerations.
  • Negotiation, proceedings or enforcement within the agreed mandate.
  • Updates identifying progress, outstanding information and decisions required.

What to prepare

  • Names of the parties and the debtor’s location.
  • Contract, invoices, payment history and a short chronology.
  • Existing judgments or proceedings, if any.
  • Known assets and any urgent deadlines.

Before you begin

Do you guarantee recovery?

No. A favourable judgment does not itself establish that recoverable assets exist. We assess the claim and recovery position separately.

Can you begin while I remain overseas?

Initial information can be reviewed remotely. The documents and formalities needed for representation are determined for the specific matter.

What if I have an overseas judgment?

We first assess the applicable route in mainland China. Recognition or enforcement of a foreign judgment is a separate question and is not automatic.

FEES & YOUR NEXT DECISION

Agree the scope before committing.

01

Confirm whether we can assist

Outline the issue, location, urgent dates and parties so scope and conflicts can be checked. Initial contact is not a formal legal opinion.

02

Agree a scoped assessment

Where a document review is needed, agree the fee and deliverables first: evidence gaps, possible routes and recommendations for the next stage.

03

Choose the next mandate

Negotiation, proceedings, enforcement or defence work is agreed by stage. Additional work and third-party expenses are identified separately.

The responsible firm, billing currency, payment account and payment method are confirmed in the engagement.
