When we can help
- A Hong Kong civil or commercial judgment requires recognition and enforcement on the mainland.
- A foreign court judgment needs to be assessed for recognition and enforcement in mainland China.
- A debtor has mainland assets against which a Hong Kong or other overseas arbitral award may be enforced.
- Overseas counsel needs mainland input on the documents and steps required for an application.
What the mandate may cover
- Review the origin, nature and status of the decision and the relevant arrangement, treaty or other rules.
- Assess jurisdiction, time limits, procedural obstacles and known asset information.
- Provide a matter-specific checklist for the decision, supporting certificates, authority documents and translations.
- Represent the applicant under an agreed mandate and address subsequent enforcement or preservation where available.
What to prepare
- The jurisdiction, court or arbitral institution and type of matter.
- The parties, decision date, status and a summary of the relief awarded.
- Known service, appeal or set-aside issues and any payments already made.
- The mainland debtor and known asset locations; detailed files follow a conflict check.
Before you begin
Do all overseas decisions follow the same route?
No. Hong Kong judgments, foreign judgments and arbitral awards may fall under different arrangements and rules. Eligibility and documents must be reviewed separately.
Is recognition or recovery guaranteed?
No. The decision must satisfy the applicable requirements. Even after recognition, actual recovery depends on assets and enforcement.
Is an apostilled document covered by this service?
Ordinary document-use issues are addressed under Overseas Documents for Use in Mainland China. An apostille is not the recognition or enforcement of a judgment or award.
